You may vary an environmental permit, for example for a water discharge, to add a mining waste operation to it. There are a few scenarios as to how this could happen:
A separate water discharge from the extraction site:
- the existing water discharge is from the extraction site, and not from the mining waste operation. It already has an environmental permit for the water discharge (a standalone regulated facility). You can add the mining waste operation to that permit, if it is managed by the same operator. If this would be a standard rules activity (inert), we can add the standard rules to the conditions for the water discharge.
An integral water discharge to the mining waste:
- you can apply to vary the environmental permit for this existing water discharge to add a standard rules facility.

The Environment Agency must decide whether to grant or refuse the applications listed on this page. If it grants an application, it must also decide what conditions should be included in the permit.
