Summary
The Environment Agency welcomes the opportunity to respond to the Department for Environment, Food and Rural Affairs consultation on proposals to replace existing powers to control the release, removal and keeping of live fish in inland waters in England and Wales with a new regulatory scheme. The scheme will be implemented through a Statutory Instrument, under powers gained in clause 232 of the Marine and Coastal Access Act 2009.
We believe the scheme will enable the Environment Agency to better regulate all stages of the movement of live fish, focusing on the environmental outcome, whilst also reducing the administrative burden on industry and ourselves. We have worked with Defra to develop the scheme and fully support its implementation as outlined in the consultation.
